These Terms of Service ("Terms") govern your use of EpikReach's website at epikreach.com and any related website design, hosting, and local SEO services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who we are

EpikReach is a sole proprietorship ("we," "us," "our"). We provide website design, hosting, and local SEO services to small businesses.

2. Eligibility and customer information

To use the Service you must be at least 18 years old and capable of entering into a binding contract. You agree to provide accurate business, billing, and contact information so we can deliver the Service.

3. Subscriptions and billing

Plans and fees

Our services are provided on a subscription basis. The specific services, features, and fees that apply to you are those described on our website or in the plan you select at signup. Pricing is in U.S. dollars and may change with 30 days' notice to existing subscribers.

Recurring billing

Subscriptions automatically renew each billing period until canceled. By starting a subscription, you authorize us (via our payment processor) to charge your payment method on each renewal date.

Cancellation

You may cancel at any time by emailing us at contact@epikreach.com. Cancellation takes effect at the end of the current billing period. After cancellation, service continues until that period ends, but you will not be charged again.

Refunds

We do not offer prorated refunds for partial billing periods. If you believe a charge was made in error, contact us within 30 days and we will review in good faith.

4. What we provide

Depending on the plan you select, our services may include:

• A custom-built website.
• Website hosting.
• Mobile-optimized design with click-to-call functionality.
• Ongoing content updates while your subscription is active.
• Local SEO services and performance reporting.

5. What you provide

• Accurate information about your business, services, and contact details.
• Permission to use your business name, logos, photos, and other materials you supply for the purposes of building and maintaining your website.
• Timely responses to requests for information or approvals (this prevents delays).

6. Domain registration and transfers

Where your plan includes a custom domain, we may register a domain in your name and connect it to your website. Any domain registered on your behalf is your property.

If you cancel after a custom domain has been registered for you, we will transfer the domain to a registrar account of your choice within 30 days at no cost. We do not hold domains hostage.

7. Acceptable use

You agree not to use the Service to:

• Host content that is illegal, fraudulent, defamatory, or infringes others' rights.
• Send spam or unsolicited marketing through any system we provide.
• Attempt to compromise the security or integrity of the Service.
• Resell or repackage our Service without our written consent.

We reserve the right to suspend or terminate service for customers that violate these rules, with or without notice depending on severity.

8. Intellectual property

You retain ownership of your business name, logos, photos, and other materials you supply. We retain ownership of the underlying website templates, code, design systems, and any reusable components we build, and grant you a non-exclusive license to use them on your website while you have an active subscription.

On cancellation, you keep any custom domain registered in your name and any content you supplied. The website design, templates, and code remain our property under the licensing terms above. We may continue to use anonymized analytics and case-study learnings to improve our service.

9. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee:

• Specific search engine rankings, lead volumes, or revenue outcomes (SEO results depend on many factors outside our control).
• Uninterrupted or error-free Service (though we strive for high uptime).

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, EpikReach's total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages, even if we were advised of the possibility.

11. Termination

You may stop using the Service at any time by canceling your subscription. We may terminate or suspend service for violation of these Terms, prolonged non-payment, or for any reason with reasonable notice. Sections of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

12. Governing law

These Terms are governed by applicable law, without regard to conflict-of-laws principles. Any disputes will be brought in courts with proper jurisdiction.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days in advance. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
