Terms of Service

These Terms of Service ("Terms") govern your use of EpikReach's website at epikreach.com, the client portal at app.epikreach.com, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who we are

EpikReach is a sole proprietorship operated from Pembroke Pines, Florida ("we," "us," "our"). We provide website design, hosting, and local SEO services to small businesses, primarily in the South Florida home-services trades.

2. Eligibility and accounts

To use the Service you must be at least 18 years old and capable of entering into a binding contract. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for activity under your account.

3. Subscriptions and billing

Plans

We currently offer two subscription plans:

• Foundation — $99/month: custom website, hosting, click-to-call, and monthly content updates.
• Growth — $249/month: everything in Foundation, plus Google Business Profile management, weekly posts, citation work, and monthly performance reports.

Pricing is in U.S. dollars and may change with 30 days' notice for existing subscribers.

Free first month

New customers receive their first month free. You may cancel at any time during the first 30 days at no charge. If you do not cancel before the trial ends, your card will be charged the standard monthly rate on the 31st day.

Recurring billing

Subscriptions automatically renew each month until canceled. By starting a subscription, you authorize us (via Stripe) to charge your payment method on each renewal date.

Cancellation

You may cancel at any time from your account dashboard ("Manage billing"). Cancellation takes effect at the end of the current billing period. After cancellation, you retain access until that period ends, but you will not be charged again.

Refunds

We do not offer prorated refunds for partial months. If you believe a charge was made in error, contact us within 30 days and we will review in good faith.

4. What we provide

• A custom-built website hosted at a domain we register on your behalf (the domain remains yours and transfers to you on cancellation).
• Mobile-optimized design with click-to-call functionality.
• Monthly content updates while your subscription is active.
• Local SEO services and monthly performance reports (Growth plan only).
• Access to a client portal for viewing reports and managing billing.

5. What you provide

• Accurate information about your business, services, and contact details.
• Permission to use your business name, logos, photos, and other materials you supply for the purposes of building and maintaining your website.
• Timely responses to requests for information or approvals (this prevents delays).

6. Domain registration and transfers

During your free first month, your website is hosted on a temporary subdomain of our preview domain (for example, yourbusiness.epikreach.com). We do not register a custom domain on your behalf during this trial period.

Once your first paid monthly fee is received (30 days after your Launch Date), we will register a custom domain in your name and connect it to your website. The domain is registered to you and is your property.

If you cancel after a custom domain has been registered for you, we will transfer the domain to a registrar account of your choice within 30 days at no cost. We do not hold domains hostage.

If you cancel during the free first month, no custom domain will have been registered, and there is nothing to transfer.

7. Acceptable use

You agree not to use the Service to:

• Host content that is illegal, fraudulent, defamatory, or infringes others' rights.
• Send spam or unsolicited marketing through any system we provide.
• Attempt to compromise the security or integrity of the Service.
• Resell or repackage our Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.

8. Intellectual property

You retain ownership of your business name, logos, photos, and other materials you supply. We retain ownership of the underlying website templates, code, design systems, and any reusable components we build, with a non-exclusive license to you to use them on your website while you have an active subscription.

Cancellation during your first two months (your free first month plus your first paid month): the website itself is not transferred to you, and we retain all rights to the pre-built website design and files. You keep any domain that has been registered in your name (which only happens after your free first month) and any content you supplied.

Cancellation after your first two months: you keep your custom domain and any content you supplied. The website design and files remain our property under the licensing terms above. We may continue to use anonymized analytics, screenshots, and case-study learnings to improve our service.

9. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee:

• Specific search engine rankings, lead volumes, or revenue outcomes (SEO results depend on many factors outside our control).
• Uninterrupted or error-free Service (though we strive for high uptime).

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, EpikReach's total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages, even if we were advised of the possibility.

11. Termination

You may stop using the Service at any time by canceling your subscription. We may terminate or suspend your account for violation of these Terms, prolonged non-payment, or for any reason with reasonable notice. Sections of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any disputes will be brought exclusively in the state or federal courts located in Broward County, Florida.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days in advance. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
